They're threatening to sue because they think because they own the photo the Shepard Fairey Obama poster is based on, they own the image in the poster.

Google "Shepherd Fairey + plagiarism."
Fairey is an art thief, and the promised lawsuits and resulting court decisions are going to button up a narrow, restrictive definition of Fair Use that will make bloggers' lives miserable. Also.
