Now, This Might Make Blogging Important

Amazing. Richard Posner is blogging this week over at Lessig's place. For a lawyer/blogger, this is a "holy shit" moment. The man's ideas about law and economics may have provided intellectual cover for a couple of generations of reactionary lawyers who want to protect property and privilege, but he's a major, major thinker who can't just be dismissed.

Posner's my kind of potential nominee to SCOTUS, which will never happen because the religious right would go nuts as soon as it was let out that he was short-listed.

won't he have to recuse himself on any case that comes up related to what he's written about online? It seems like I recall Scalia having to do that recently...

He's being careful not to talk about any pending cases. Scalia was not.
